The letter provides recognition for provisions in collective bargaining agreements between qualified union employers or groups of employers and the exclusive representatives of their employees to establish certain obligations and procedures relating to workers' compensation.
The recognized provisions may not diminish workers' compensation benefits provided by law, but they may provide for an alternative dispute resolution program; an agreed upon list of medical providers which may be the exclusive source of medical treatment; a limited list of impartial physicians to conduct independent medical exams; creation of a light duty, modified job, or return to work program; a limited list of rehabilitation providers; or, establishment of safety committees and safety programs.
