Minnesota Is Reviewing Cannabis Records
The State of Minnesota is reviewing marijuana-related records and thousands of cases have already been expunged (removed from public view). Learn more about the process and how it could affect you.
Some older laws use the word “marijuana” instead of “cannabis.” You may also see “THC” or other terms in court papers. Marijuana and THC products are derived from “cannabis,” the scientific name for the plant. Cannabis is used to refer to all of these terms.
In 2023, the legislature passed Minnesota’s Adult-Use Cannabis Act. In addition to legalizing adult use of marijuana, the new law paved the way for the automatic expungement (sealing) of certain cannabis charges (misdemeanor convictions and specific offenses not resulting in a conviction), thereby helping remove barriers to employment and housing for many people.
The Adult-Use Cannabis Act also established the Cannabis Expungement Board (CEB) to review Minnesota felony cases and some misdemeanor and gross misdemeanor cases. These cases are not eligible for automatic expungement and must go through a separate, more extensive review process.
