Data Request

The Minnesota Government Data Practices Act (Minnesota Statutes Chapter 13) gives every individual important rights when State Agencies collect, create, receive, maintain, or disseminate data. The Board must assign a responsible authority to facilitate compliance with Minnesota Government Data Practices Act requirements. The responsible authority for the Minnesota Board of Barber Examiners is:

The law presumes that all government data are public unless a state or federal law says that the data are not public. Data are classified by state law as public, private, or confidential.

  • Public Data: We must give public data to anyone who asks; it does not matter who is asking for the data or why.
  • Private Data: We cannot give private data to the general public. We can share private data with the subject of the data, someone who has specific written permission from the subject, the subject’s legal guardian or legal representative, with Board members, and Board staff who need the data to do their work, and with others as permitted by law or court order.
  • Confidential Data: Confidential data has the most protection. We cannot give members of the public any access to confidential data. Nor can we give the subject of the data access to confidential data. We can share confidential data with Board members and staff who need the data to do their work and to others as permitted by law or court order.
In order to look at or to request copies of data that the Board maintains, a written request must be submitted to the responsible authority. The written request should include:
  1. A statement that the letter is a request for data under the Minnesota Government Data Practices Act (Minnesota Statutes Chapter 13).
  2. Whether the requester would like to look at the data, obtain copies of the data, or both.
  3. A clear description of the data requested.

The Board cannot require an individual requesting data to identify themselves or explain the reason for the data request. However, depending on how they want us to process the request (mail copies of data) we may need information about the requester to complete the request. If we do not understand the request and have no way to contact the requester, we cannot process the request.

The Board is not required to create or collect new data in response to a data request if we do not already retain the data, or to provide data in a specific form or arrangement if we do not maintain the data in that format. 
Upon receiving a written data request, the Board will work to process it in a reasonably timely manner.
 

  • If we do not have the data, we will notify the requester in writing as soon as reasonably possible.
  • If we have the data, but the data are not public, we will notify the requester in writing as soon as reasonably possible and state which specific law says the data are not public.
  • If we have the data, and the data are public, we will respond to the request appropriately and promptly, within a reasonable amount of time, by doing one of the following:
    • Arrange a date, time, and place for inspection of the data, for free, if the request is to look at the data, or
    • Provide copies of the data as soon as reasonably possible.  The requester may choose to pick up copies, or we will mail or fax them.  The requester will need to provide us with an address or fax number. We will provide electronic copies upon request if we keep the data in electronic format.
  • For copies of 25 or fewer pages of black-and-white letter-sized paper copies there is no fee.
  • For copies of more than 25 pages the fee is $.25 for each additional page.  
  • For copies of other data (more than 100 black/white paper copies; or any color copies, photographs, etc.), the requester will be charged the actual cost for employee time to search for and retrieve the data; and the cost to make copies.
To request data from the Minnesota Board of Barber Examiners, you will need to complete a Data Request Form and submit it to the Board.
