The following notices of biofuel waivers were published before the current calendar year.

Notice of Biodiesel Outage and Waiver at Magellan Terminal – Alexandria, MN - between 11:45 A.M., June 26, 2023, and 6:30 A.M. June 27, 2023
he Magellan terminal located in Alexandria, MN has notified the Minnesota Department of Commerce Weights and Measures Division that the terminal did not have biodiesel available for loading at the rack between 11:45 am, June 26, 2023, and 6:30 am June 27, 2023.

Retailers may be granted a waiver under Minnesota Statutes §239.80 on diesel loads bought from Magellan terminal in Wrenshall during the biodiesel outage if:
1. The retailer,or its purchasing agent, was already an existing customer of Magellan terminal in Alexandria at the time of the biodiesel outage; and
2. The retailer is obligated to meet the requirements of Minnesota Statutes §239.77 because the retailer sells diesel fuel for use in internal combustion engines; and
3. The retailer had insufficient time to arrange for alternative sources of biodiesel to meet statutory requirements.
The Weights and Measures Division will determine a retailer’s eligibility for this waiver through bills of lading or other information obtained by the Weights and Measures Division from the retailer and from Magellan terminal Alexandria under the auditing authority granted in Minnesota Statutes §§239.011, 239.75, and 239.753.

This waiver applies only to loads pulled from the Magellan – Alexandria, MN terminal loading rack between 11:45 am, June 26, 2023, and 6:30 am June 27, 2023.

Diesel sold for use in combustion engines under any conditions other than those outlined in a waiver granted by the Weights and Measures Division must have the minimum amount of biodiesel required under Minnesota Statutes §239.77, or retailers may face penalties under Minnesota Statutes §239.80

The Magellan terminal located in Wrenshall, MN has notified the Minnesota Department of Commerce Weights and Measures Division that the terminal does not have biodiesel available for loading at the rack as of 5:00 PM, May 23, 2023..

Retailers may be granted a waiver under Minnesota Statutes §239.80 on diesel loads bought from Magellan terminal in Wrenshall during the biodiesel outage if:
1. The retailer,or its purchasing agent, was already an existing customer of Magellan terminal in Alexandria at the time of the biodiesel outage; and
2. The retailer is obligated to meet the requirements of Minnesota Statutes §239.77 because the retailer sells diesel fuel for use in internal combustion engines; and
3. The retailer had insufficient time to arrange for alternative sources of biodiesel to meet statutory requirements.
The Weights and Measures Division will determine a retailer’s eligibility for this waiver through bills of lading or other information obtained by the Weights and Measures Division from the retailer and from Magellan terminal Alexandria under the auditing authority granted in Minnesota Statutes §§239.011, 239.75, and 239.753.

This waiver will remain in effect until 5:00 pm, June 2, 2023, or until biodiesel is restored at the Magellan – Wrenshall, MN terminal, whichever comes first.

Diesel sold for use in combustion engines under any conditions other than those outlined in a waiver granted by the Weights and Measures Division must have the minimum amount of biodiesel required under Minnesota Statutes §239.77, or retailers may face penalties under Minnesota Statutes §239.80

The Flint Hills Resources Pine Bend terminal located in Rosemount, MN has notified the Minnesota Department of Commerce Weights and Measures Division that the terminal did not have biodiesel available for loading at the rack between 7:25 AM, June 7, 2022 and 11:35 AM, June 7, 2022.

1. The retailer, or its purchasing agent, was already an existing customer of Flint Hills Resources Pine Bend terminal in Rosemount at the time of the biodiesel outage;
2. The retailer is obligated to meet the requirements of Minnesota Statutes §239.77 because the retailer sells diesel fuel for use in internal combustion engines; and
3. The retailer had insufficient time to arrange for alternative sources of biodiesel to meet statutory requirements.
The Weights and Measures Division will determine a retailer’s eligibility for this waiver through bills of lading or other information obtained by the Weights and Measures Division from the retailer and from Flint Hills Resources Pine Bend terminal in Rosemount under the auditing authority granted in Minnesota Statutes §§239.011, 239.75, and 239.753.

This waiver applies only to loads pulled from the Flint Hills Resources Pine Bend terminal in Rosemount loading rack between 7:25 AM, June 7, 2022, and 11:35 AM June 7, 2022.

Diesel sold for use in combustion engines under any conditions other than those outlined in a waiver granted by the Weights and Measures Division must have the minimum amount of biodiesel required under Minnesota Statutes §239.77, or retailers may face penalties under Minnesota Statutes §239.80.
