Cannabis vs. Marijuana<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

Some older laws use the word \u201cmarijuana\u201d instead of \u201ccannabis.\u201d You may also see \u201cTHC\u201d or other terms in court papers. Marijuana and THC products are derived from \u201ccannabis,\u201d the scientific name for the plant. In 2023, the legislature passed Minnesota’s Adult-Use Cannabis Act. In addition to legalizing adult use of marijuana, the new law paved the way for the automatic expungement (sealing) of certain cannabis charges (misdemeanor convictions and specific offenses not resulting in a conviction), thereby helping remove barriers to employment and housing for many people.<\/p>

The Adult-Use Cannabis Act also established the Cannabis Expungement Board (CEB) to review Minnesota felony cases and some misdemeanor and gross misdemeanor cases. These cases are not eligible for automatic expungement and must go through a separate, more extensive review process.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t

If You Have a Cannabis Misdemeanor<\/h4>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

If you have a past misdemeanor marijuana conviction, your record may already be sealed. The Minnesota Department of Public Safety Bureau of Criminal Apprehension has expunged approximately 57,000 cannabis-related records. You can check online<\/a><\/span> to see if your court record is sealed. Some misdemeanor cannabis convictions are ineligible for expungement.<\/div>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t

Cannabis felony convictions, along with some misdemeanor and gross misdemeanor cases, are reviewed by the Cannabis Expungement Board (CEB).
