Self-Disclosure Requirements

 

The EMSRB understands that everyone makes mistakes. That said, we have a responsibility to ensure those who provide emergency medical services in Minnesota are able to do so in a safe, capable manner. While criminal convictions do not define you, they are indicators of your ability to safely practice emergency medicine. Minnesota Statutes require you to disclose the information in your application for your registration or certification. The EMSRB does not pass judgement on criminal convictions. but the convictions are used to determine your ability to provide emergency medical services.

You are required to report specific events in your application with the EMSRB. If you have not, there may be disciplinary action taken against your certification or registration. The discipline can range from a warning letter to a revocation of your certification/registration. Minnesota Statute section 144E.27, subdivision 5(a)(12)/144E.28 subdivision 5 (a)(12) requires you to cooperate with this request for information. A substantiated non-disclosure, regardless of the time that has elapsed since the conviction, is a violation of the following Statute:

Emergency Medical Responder Registration

Minnesota Statute 144E.27, subdivision 5 (a)(2)

The board may deny, suspend, revoke, place conditions on, or refuse to renew the registration of an individual who the board determines misrepresents or falsifies information on an application form for registration.

EMT/AEMT/Paramedic Certification

Minnesota Statute 144E.28, subdivision 5 (a)(2):

The board may deny, suspend, revoke, place conditions on, or refuse to renew the certification of an individual who the board determines misrepresents or falsifies information on an application form for certification.

Self-Disclosure Specific Statutes

The following statues highlight what type of events you are required to report in your application. These disclosures are required for your initial application. Every application and renewal you submit requires you to complete self-disclosure information. If you obtain a conviction after your initial licensure, you are required to report that event to the EMSRB.

Emergency Medical Responder Registration

Minnesota Statute 144E.27, subdivision 5 (a)(3):

The board may deny, suspend, revoke, place conditions on, or refuse to renew the registration of an individual who the board determines is convicted or pleads guilty or nolo contendere to any felony; any gross misdemeanor relating to assault, sexual misconduct, theft, or the illegal use of drugs or alcohol; or any misdemeanor relating to assault, sexual misconduct, theft, or the illegal use of drugs or alcohol.

Minnesota Statute 144E.27, subdivision 5 (a)(7):

The board may deny, suspend, revoke, place conditions on, or refuse to renew the registration of an individual who the board determines violates any state or federal controlled substance law

Minnesota Statute 144E.27, subdivision 5 (a)(10):

The board may deny, suspend, revoke, place conditions on, or refuse to renew the registration of an individual who the board determines is subject to a denial, corrective, disciplinary, or other similar action in another jurisdiction or by another regulatory authority.

Minnesota Statute 144E.28, subdivision 5 (a)(10):

The board may deny, suspend, revoke, place conditions on, or refuse to renew the registration of an individual who the board determines is subject to a denial, corrective, disciplinary, or other similar action in another jurisdiction or by another regulatory authority.

Other State Actions

The EMSRB is required to deny, revoke, or refuse to renew certain credentials due to State actions regarding tax and child support delinquency. The EMSRB does not have authority to refuse these statutory requirements. If you receive notice that your credential may be affected due to tax or child support delinquency, contact the agency who provided us the information. The EMSRB cannot act as a representative on your behalf. We cannot insert ourselves into the clearance of your certification.

Minnesota Statute 270C.72, subdivision 1: Minnesota Department of Revenue Tax Clearance

The EMSRB may not issue, transfer, or renew, and must revoke a registration or certification if the applicant owes the state $500 or more in delinquent taxes payable to the Minnesota Department of Revenue (DOR), penalties, or interest. The EMSRB will send the subject a letter within 10 days notifying them of the potential notification. The EMSRB must revoke the certification or registration 30 days after receiving the notice from the DOR, unless we receive a tax clearance certificate from the DOR. The EMSRB may only re-issue the credential once we receive a written clearance certificate from the DOR. Further, we cannot contact the MN DOR on your behalf. 

Minnesota Statute 214.101 Child Support; Suspension of License

If the EMSRB receives an Order of Suspension from an entity responsible for child support enforcement, defined under Minnesota Statute 518A.66, in the State of Minnesota, the EMSRB may not issue, reinstate, or renew a credential to that person. We are required to maintain the suspension until we receive notification that payment compliance has been achieved. The EMSRB cannot contact any child support enforcement agency on your behalf.
