Rulemaking

Rulemaking is an important government function that allows state agencies to adopt, amend, or repeal rules. A “rule” is like a statute passed by the legislature, except rules are adopted by executive branch agencies. Both a rule and a statute have the force and effect of law. We all must follow both.

A statute is usually more general and establishes the basic form and function of the law. Rules are more specific. They take a particular statute and fill in gaps needed to help people understand how the statute applies in more specific situations.

In Minnesota, agencies accomplish rulemaking by following the Minnesota Administrative Procedure Act (APA) under Minnesota Statutes, chapter 14, and Minnesota Rules, chapter 1400. Agencies must follow the APA’s many requirements and procedures while accomplishing two main goals: accountability and transparency.

As part of the rulemaking process, a state statute, specifically Section 14.366 , requires agencies to maintain a current rulemaking docket containing a list of each possible proposed rule under active consideration and each pending rulemaking proceeding.
