What is included in the Workers' Compensation Decisions case archive?
The case archive currently includes decisions issued by the court from 1999 through 2014. These decisions include all opinions issued by the Workers' Compensation Court of Appeals (WCCA), published and unpublished, but, as a general rule, do not include administrative orders. The case archive also includes Minnesota Supreme Court opinions in appeals from decisions of the WCCA, both summary affirmances and written opinions.

 

How frequently is the Workers' Compensation Decisions case archive updated?
As a general rule, newly issued cases are added within 5 to 10 days after filing and service on the parties.

 

What does a search return?
A search will return the title of the case, a summary of the headnotes (syllabus) for the case, and the date on which the case was served and filed.

 

How do I read a case that is returned by my search?
To open and read a case, double-click on the title of the case.

 

Is there an index of cases included in the Workers' Compensation Decisions case archive?
To see an alphabetical list of all cases issued in a particular year, with the date each case was served and filed, select a year and type the word "Contents" (without the quote marks) in the search box. Double-click on Contents of . . . to open the list. Double-clicking on a case title opens the case.

 

How do I search for cases by date?
      Simple: In the basic search window, (1) select a year then (2) type the name of the month in capital letters in the search box (e.g., MARCH). The request will return all cases issued in that month and year. To find a specific date, type in the month and date in quotation marks (e.g., "MARCH 25"). For multiple months, separate the names of the months with a comma (e.g., JANUARY, FEBRUARY, MARCH).
      Advanced: Click on the Advanced link near the 'Search' button. In the advanced search window, at 'Search:', select a year, then scroll down to 'dated'. Select a period of time (e.g., 'in the last week' or 'in the last 30 days') from the drop-down box (click on small arrow on the right side). Or select 'on or after' and enter the dates for the time period during which you wish to obtain cases. Click on 'Search'.

 

Does the court plan to add cases prior to 1999?
The WCCA will add older decisions to the case archive as staff work loads permit. For decisions not in the case archive see the Workers' Compensation Decisions volumes published by the Minnesota Department of Administration (Minnesota's Bookstore) (651 297-3000 or 1-800-657-3757). A subscription service including all cases (published and unpublished) or published cases only is available through the bookstore. One-time copies of individual cases can be obtained by contacting the WCCA.

 

How do I cite cases found on the web case archive?
Cite cases by the case name (title), case number (if given) or "slip op.", court name, and date issued. For example, McLeod v. Magnusen Farms, No. WC06-224 (W.C.C.A. Apr. 10, 2007); Harstad v. Park Mfg., slip op. (W.C.C.A. Aug. 28, 2002). The court does not have access to electronic databases such as Westlaw or Lexis and the citation method used here is preferred.
