Extended Opportunity to Provide Public Comment on Otter Tail Power Company’s Request for an Advance Determination of Prudence for the Big Stone Plant Air Quality Control System Project

Due to the state government shutdown, the schedule in the proceeding for Otter Tail Power Company’s request for an advanced determination of prudence for the Big Stone air quality control system has been revised. The deadline for public comments has been extended to August 15, 2011, at 4:30 p.m. The evidentiary hearing is now scheduled for September 14-16, 2011.
On January 14, 2011, Otter Tail Power Company asked the Minnesota Public Utilities Commission (MPUC) for an advance determination of prudence for a proposed Air Quality Control System Project at its Big Stone Plant near Milbank, South Dakota. The project would reduce emissions of sulfur dioxide, nitrogen oxides, and particulate matter to comply with South Dakota administrative rules adopted to address regional haze under the federal Clean Air Act.
Otter Tail Power Company estimates Minnesota’s share of this project would cost $132 million. If the MPUC finds the project to be prudent, how Otter Tail Power Company may recover project costs, and the level of costs recoverable, would be determined at a later date. Otter Tail Power Company must show that the costs are reasonable and necessary and demonstrate its efforts to ensure the lowest reasonable project costs.
Administrative Law Judge Eric L. Lipman will hold a formal evidentiary hearing about this project. The hearing is scheduled to start on September 14, 2011, at 9:30 a.m., at the Public Utilities Commission, 121 Seventh Place East, Suite 350, St. Paul, Minnesota.
The purpose of the evidentiary hearing is to allow Otter Tail Power Company, the Minnesota Department of Commerce, and other formal parties to this case to present testimony and to cross-examine each other’s witnesses as to the reasonableness of the project. If time allows, limited public participation may also be permitted during the evidentiary hearing.
