The proposed rule amendments of the Environmental Quality Board relating to the threshold for mandatory preparation of Environmental Assessment Worksheets for greenhouse gas emissions (Minnesota Rules Part 4410.4300, subpart 15) was assigned to Judge Barbara Neilson.
As part of the rulemaking process, a hearing was held on March 9, 2011, at the Minnesota Pollution Control Agency in St. Paul. During the hearing, a twenty-calendar-day period was set for the receipt of written comments regarding the proposed rules. Thus, the initial deadline for the submission of written comments in this rulemaking proceeding was March 29, 2011.
After the period for submission of written comments ends, state law provides the agency and all interested persons an additional period of five working days for filing a written response to any comments which were submitted during the initial comment period. New matters may not be introduced or raised during this five-day rebuttal period. The five-day rebuttal period expired at 4:30 pm on April 5, 2011.
Judge Neilson issued her Final Report on May 9, 2011.
