  October 31, 2012 - On October 29, 2012, Yvonne Selcer filed a Complaint with the Office of Administrative Hearings alleging that the Respondent, the Republican Party of Minnesota, violated Minn. Stat. § 211B.06. The Complaint alleges that Ms. Selcer “failed to pay her own 2012 property taxes on time” in a campaign brochure that was mailed to voters in House District 48A. Ms. Selcer is a candidate for election to the Minnesota House of Representatives from House District 48A. The Complaint asserts that because Ms. Selcer paid the taxes that were due and owning in a timely fashion, the contrary assertion in the brochure is false and violates Minn. Stat. § 211B.06.

  October 30, 2012 - On October 25, 2012, Ken Martin filed a Complaint with the Office of Administrative Hearings alleging that Respondent Stephen Sundquist violated Minn. Stat. § 211B.06, subd. 1. The allegations relate to a Letter to the Editor that was published in the Brainerd Dispatch regarding the Minnesota House District 10B race. After reviewing the Complaint and the attached documents, and for the reasons set out in the Memorandum below, the Administrative Law Judge finds that the Complaint fails to set forth a prima facie violation of Minn. Stat. § 211B.06. IT IS HEREBY ORDERED that: The Complaint filed by Ken Martin against Stephen Sundquist is DISMISSED.

Stat. § 211B.15, subd. 2; that Respondent Dennis DeKeyrel violated Minn. Stat. § 211B.15, subd. 13; that Respondent Ken Tschumper for Minnesota House committee violated Minn. Stat. § 211B.13, subd. 2; and that Respondents Ken Tschumper and Dennis DeKeyrel violated Minn. Stat. § 211B.04. The Panel further concludes that the Complainant failed to establish that Respondent Dennis DeKeyrel violated Minn. Stat. § 211B.15, subd. 2.
