June 29, 2012 - This Recommendation addresses only the following Respondents who failed to appear at the Prehearing Conference on September 7, 2011: Accredited Financial, Inc., Eagle River Financial, LLC, OFC Properties, Inc., RP New Horizons, LLC, and Alex Sanchez. Based on the failure of such Respondents to appear at the Prehearing Conference, to provide an address where service can be made, and based on the record as a whole, the Administrative Law Judge recommends that the Commissioner issue an Order affirming some of the alleged violations, as set forth in the Statement of Issues and Memorandum.
June 22, 2012 - Engaged in fraudulent, deceptive, or dishonest practices, and otherwise engaged in acts that demonstrate he is untrustworthy, financially irresponsible, or otherwise incompetent or unqualified to act under the license granted by the Commissioner, as provided in Minn. Stat. §§ 45.027, subd. 7(a)(4), and 82.82, subd. 1(b) (2010)? Failed to notify the Commissioner that he was charged with and convicted of a felony, as required by Minn. Stat. §§ 45.027, subd. 7(a)(2), and 82.65, subds. 1 and 5? Failed to notify the Commissioner of a change in his street address within ten days, as required by Minn. Stat. §§ 45.0112 and 45.027, subd. 7(a)(2)?IT IS RECOMMENDED that the Commissioner take appropriate disciplinary action against the real estate salesperson license of George Comb.

June 20, 2012 - Did the Respondent violate an Occupational Safety and Health (OSH) rule, Minn. R. 5205.0110, subp. 3 (2011), which requires an employer to maintain a minimum air temperature of 60 degrees Fahrenheit in indoor workrooms where work of a strenuous nature is performed? If so, what penalty is appropriate? The Administrative Law Judge concludes the Respondent did not violate the rule in question. IT IS HEREBY ORDERED that: the citations are REVERSED.
