Preemployment Inquiry & Citizenship

Inquiring about a person's citizenship

Asking whether an applicant is a U.S. Citizen during a job interview is generally prohibited. The federal Immigration Reform and Control Act of 12986 (IRCA) makes it illegal for employers to discriminate based on a person's citizenship or immigration status during hiring, firing, recruitment or referral for a fee.
