Nature of Misconduct:   Unethical and unprofessional conduct; improper management of medical records; inappropriate prescribing practices.

 

Action Taken:   Dr. Ebrahimi’s license is conditioned as follows:

 

1.      He is reprimanded;

2.      He shall read the Model Policy for pain control published by the Federation of State Medical Boards and Responsible Opioid Prescribing, A Clinician's Guide, 2nd Edition, by Scott M. Fishman, M.D.;

3.      He shall complete, within one year, the following pre-approved courses:

    1. Chemical dependency awareness.
    2. Boundaries.

4.      Six months following successful completion of the pre-approved courses, he shall undergo an audit of his prescribing practices;

5.      Before prescribing a Schedule II-IV drug, he shall check the Minnesota Prescription Monitoring Program;

6.      He shall develop, and submit for Committee approval, a written protocol for the management and tracking of controlled substance prescriptions;

7.      He shall develop, and submit for Committee approval, a narcotics agreement to be used with all chronic pain patients;

8.      He shall pay a civil penalty of $6575.60;

9.      This Stipulation and Order will remain in effect for a minimum of one year.  At the end of this period, he may petition for reinstatement of an unconditional license.  Upon hearing the petition, the Board may continue, modify or remove the conditions set out herein.

Action Taken:   Dr. Muehlstedt’s license is suspended.  The suspension is stayed contingent upon his compliance with the following conditions:

 

1.      He is reprimanded.

2.      He shall participate in the Health Professionals Services Program (HPSP) and comply with all terms and conditions of his HPSP Participation Agreement and Monitoring Plan, including any modifications.  Failure to comply with the HPSP Monitoring Plan shall constitute a violation of this Order.

3.      He shall not prescribe, administer, or dispense any prescription drug or drug sample for his own use, his family members’ use, or for any person who is not in an established physician/patient relationship with him.

4.      He shall not prescribe Schedule II, Schedule III, and Schedule IV controlled substances without a co-signature.

5.      He shall obtain a pre-approved supervising physician who shall submit quarterly reports to the Board.

6.      He may petition for reinstatement of an unconditional license upon submission of satisfactory evidence of four years of documented, uninterrupted recovery, and upon successful completion of the terms of this Order.

Action Taken:   Dr. Philaya’s license is suspended as follows:

 

1.      He is reprimanded.

2.      His license is indefinitely suspended.

3.      During the suspension, he shall not practice medicine and surgery in Minnesota.

4.      He may petition for reinstatement of his license upon completion of a comprehensive skills assessment at the Center for Personalized Education for Physicians (CPEP), concluding that he is fit and competent to resume the practice of medicine and upon submission of satisfactory evidence of a minimum of 18 months of documented, uninterrupted recovery.

5.      Upon petitioning for reinstatement, the Complaint Review Committee may request that he meet with the Committee to discuss his petition.  Upon hearing the petition, the Committee may recommend that the Board continue, modify, or remove the suspension or impose conditions and restrictions as deemed necessary.

6.      He shall sign releases allowing the Board access to all treatment records.
